DEFENDANT GORDON T. DAVIS’ ANSWER

Now come the Pro Se Defendant’s, Gordon T. Davis (Mr. Davis), answer to the Plaintiff’s complaint. It is as follows:
           
1.     The allegations in paragraph 1 of the Complaint pertain to the identification of the Plaintiff to which Mr. Davis is not required to answer.

2.     The allegations in paragraph 2 of the Complaint pertain to the identification of co defendants to which Mr. Davis is not required to answer.

3.     Admitted.

4.     Mr. Davis is without knowledge or sufficient information to form a belief about the truthfulness of the allegation in paragraph 4 of the Complaint.

5.     Denied.

6.     Denied.

7.     Denied.

8.     Denied. Mr. Davis did not write or publish the referenced item found in paragraph 8 of the Complaint.

9.     Denied. Mr. Davis did not write or publish the referenced item found in paragraph 9 of the Complaint.

10.                         Denied. Mr. Davis did not write or publish any tags whatsoever as referenced in paragraph 10 of the Complaint.

11.                         Denied. The published materials are not defamatory to Plaintiff.

12.                        Denied. Mr. Davis made no third party statement as to the truthfulness of the article he wrote.

13.                        Denied.

14.                          Paragraph 14 of the Complaint is demands for damages and consequently  Mr. Davis is not required to respond.  To the extent that paragraph 14 of the Complaint is construed to contain allegations of wrongful conduct by  Mr. Davis, those allegations are denied.

     Further answering,  Mr. Davis asserts the following defenses:

AFFIRMATIVE DEFENSES

First Affirmative Defense
The First Amendment of the U.S. Constitution bars this Complaint.
                                                Alternate Second Affirmative Defense
        The plaintiff’s reputation is already so tarnished that the      
        speech could not have harmed it further.





                                Alternate Third Affirmative Defense

     The plaintiff’s suit is frivolous and done in retaliation for a suit       
     filed by Mr. Davis against Plaintiff’s business associates Aiden
     Kearney and Turtleboy Sports.

                              Alternate Fourth Affirmative Defense

     The Plaintiff’s suit is frivolous as it was intended as a distraction from the political accusations Plaintiff was facing for posting offensive and false facebook posts.

                                Jury Claim

     Mr. Davis requests a jury trial as to all claims in this matter.

PLAINTIFF’S REQUEST TO AMEND COMPLAINT TO ADD NEW COUNT OF LIBEL

Plaintiff, Gordon T. Davis, hereby requests this honorable Court for leave to amend his complaint pursuant to Massachusetts Civil Proceeding Rule 15. This request is after the filing of the original Complaint and before the filing of the Answer Pleading.

The amendment is to add a new count of libel against the Defendants. In February 2016 after the filing of the original Complaint the Defendants again libeled the Plaintiff by publishing that he is mentally unstable, senile, and crazy. (Exhibit 1).

As grounds therefore avers to the following: 1. this lawsuit was filed on February 12, 2016 and served upon the Defendants on February 19, 2016.  During the week of February 21, 2016 the Defendants published the libel found in Exhibit 1.

The Plaintiff respectfully requests the Court for leave to amend his Complaint as seen above.

COMPLAINT

Parties

1.    The Plaintiff is Gordon T. Davis who resides in Worcester MA. The Plaintiff at the time of the violations was self employed as an Advocate helping people with discrimination cases at the Massachusetts Commission Against Discrimination and employment cases at the Department of Unemployment Assistance.

Counts

3.   In November 2015 the Defendants libeled the Plaintiff by writing in their publication that the Plaintiff, Gordon T. Davis, is mentally unstable. Please Exhibit 2.

4.   In November 2015 the Defendants wrote in their publication that the Plaintiff, Gordon T. Davis is senile. Please see Exhibit 2.

5.   In July 2015 the Defendants wrote in their publication that the Plaintiff, Gordon T. Davis is crazy.

6.   The Plaintiff Advocacy has been severely adversely affected by the libelous publications of false information about the health of the Plaintiff.

Demands

7.     Reparation for loss clients and case income for the year 2015.

8.     The Defendants cease and desist their libel.

9.     A retraction of the libelous publications about the Plaintiff health.


10. Compensation for loss clients and case income for 2016 through the period of time ending one year after the retraction of the libel.
